Former Tenant Accused of Beating Landlord to Death
A landlord in Grand Rapids was beaten to death with a baseball bat by a recently evicted tenant. The former tenant, who has a prior criminal history, is now back in jail.
Penalty for Murder in Michigan
In Michigan, homicide offenses are divided into three levels based on the circumstances of the crime: first-degree murder, second-degree murder, and manslaughter. The state abolished the death penalty in 1846.
If a killing is premeditated or occurs during the commission of a felony, it is considered first-degree murder and carries a penalty of life in prison without the possibility of parole. If the killing was intentional but not premeditated, it may be charged as second-degree murder, which is punishable by up to life in prison or any term of years depending on the circumstances. If the death occurred in the heat of passion or without malice, it may be charged as manslaughter, which carries a maximum penalty of 15 years in prison.

Landlord Beaten to Death With Baseball Bat By Former Tenant
According to WOOD-TV, A woman witnessed a recently evicted former tenant return to a Creston Heights neighborhood to confront the landlord. The witness said, "He just pounded his face in. I was pepper spraying (the assailant), tried to stop him, and I think that's when he ran at me with the bat."
Police arrived, but the landlord died at the scene. The suspect was booked into the Kent County jail.

The landlord notified the alleged assailant on December 30 that he needed to move out by January 30. When the man failed to leave, the landlord filed a lawsuit to remove him from the home. The suspect later emailed the court asking to remain in the house until the end of March, but the request was denied. Authorities say that is when he allegedly returned to confront the landlord and attacked him with a baseball bat.
Police have not released the names of the suspect or the landlord as the investigation continues. However, court records show the suspect has prior violent convictions.
