It looks as though the Black Keys will get their case heard in court. The group filed legal action earlier this year against both Pizza Hut and Home Depot, claiming that both companies had used their songs without permission in commercials.

The group stated that Home Depot had used an unauthorized version of ‘Lonely Boy’ in a Ryobi Power Tools spot and that Pizza Hut copped ‘Gold on the Ceiling’ for a Cheesy Bites Pizza promo. They, in association with their producer Danger Mouse, filed lawsuits against the companies back in mid-June.

Now, the Associated Press reports that attorney’s for both companies filed their legal responses in court this past week. Both deny that their ads improperly used the music, and they’re asking the Black Keys to cover the attorney fees should the band lose the case.

The duo did relent on licensing music within recent years, as ‘Tighten Up’ was used in several ads and helped catapult the song and the group to greater recognition. They also allowed the usage of ‘Gold on the Ceiling’ from their latest album in ads for ‘The Candidate’ and during the NCAA Final Four.
